N o new consultation was carried out for the second application which Try Homes submitted on 6th December 2006 (i.e. before the SDC meeting to consider the first application). The application was considered by IBAC (for comment) on 15th February 2007 and then by the Sustainable Development Committee on 28th March. This date exceeded the required thirteen week period for determination and, as with the first application, Try Homes appealed to the Government Planning Inspectorate on grounds of "non-determination" prior to the SDC meeting. At the SDC meeting it was unanimously agreed that were it not for the appeal the application would have been refused. The Officers' report and the grounds for refusal can be found here. Prior to the SDC meeting we circulated all the councillors on the committee with our views in the form of a Yellow Book.
The second application was for a development of 239 homes. The reduction in the number of homes was achieved by the removal of an apse which had been part of the design for the first application.
As a result of the first and second applications Try Homes now had two appeals lodged with the Planning Inspectorate. Eventually the appeal over the first application was withdrawn. A public inquiry over the second application was held 19th - 26th June 2007. We are now waiting for the results of this inquiry. The Inspector said that his decision would be published before the middle of August. Our submission to the inquiry is contained in our White Book.
